This Agreement is entered into by and between DM Companion Solutions Inc., doing business as DM Companions (“DM Companions”, “we”, “our” or “us”) and you, the end user (“you” or “user”).
By accessing, downloading, installing, or using DM Companions’ software (“the Software”) and related services (“the Services”), you acknowledge that you have read, understood, and agreed to be bound by this Agreement, as well as DM Companions’ Account Rules and Privacy Policy (incorporated herein by reference).
If you do not agree, you must immediately cease use of the Software and Services.
1. Acceptance of the Agreement
Binding Nature – By using the Software or Services in any manner, you agree to be bound by this Agreement.
Capacity – You affirm you are of legal age and capacity, or authorized to bind an entity.
Supplementary Terms – Certain Services may have additional terms which prevail if conflicting.
2. Changes to the Agreement
Right to Modify – We may amend this Agreement at our discretion.
Notice – Material changes may be posted on our site, emailed, or shown in-app.
Acceptance – Continued use after changes equals acceptance.
3. Account Registration and Use
Account Creation – You must provide accurate and current registration information.
Security – You are responsible for maintaining confidentiality of credentials.
Restrictions – No sharing, abuse, or unauthorized use of accounts.
Suspension – We may suspend or terminate accounts for violations.
4. Software Acquisition
Obtain the Software only from authorized sources.
No guarantee or liability for unauthorized sources.
5. Software Installation and Uninstallation
Select the correct version for your device/OS.
Follow installation instructions.
Additional software may be recommended but optional.
Features may differ by region.
You may uninstall at any time.
6. Software Updates
We may update the Software for improvement.
Updates may occur automatically without notice.
Older versions may become unsupported.
7. User Personal Information Protection
We protect personal information per this Agreement and Privacy Policy.
You may be required to provide accurate information.
Some information may be reviewable or updatable, but not all.
Your nickname, avatar, or activity data may be displayed.
We implement security measures to protect your data.
Disclosure exceptions: law, mergers, service necessity, or as otherwise permitted.
If you transmit to other platforms, review their policies.
Minors need parental/guardian consent.
8. User Conduct
Using Software may consume device/bandwidth resources.
Some features may disclose user info to others.
Permissions may be required for features.
You may refuse info/permissions but some Services may be unavailable.
We safeguard your data but do not guarantee absolute security.
You are responsible for risks outside our control.
9. Payment, Billing, and Refund Policy
You agree to pay fees; taxes are your responsibility.
You must provide valid payment info.
Authorization: you warrant valid use of payment method.
Recurring payments may apply to subscriptions.
Billing statements provided; errors must be reported within 90 days.
Purchases are final unless required by law; refunds discretionary.
You may cancel anytime; fees accrued remain payable.
Trial services may auto-convert to paid unless canceled.
Promotions must not be abused.
Price changes with at least 15 days’ notice.
If we must pay you, taxes/fees are your responsibility.
10. Governing Law, Contracting Entity, and Dispute Resolution
Contracting entity: DM Companion Solutions Inc.
Law: Province of British Columbia, Canada.
Disputes: Supreme Court of British Columbia, unless local consumer law dictates otherwise.
11. Warranties
Services are provided “as is” without warranties.
All implied warranties disclaimed to the extent permitted by law.
We do not guarantee uninterrupted or error-free services.
12. Limitation of Liability
Sole remedy: refund of direct damages, capped at monthly service fees.
No liability for events beyond our reasonable control (force majeure).
13. Family Features
Family features allow shared insights; use lawfully and only as intended.
Group messaging may occur; consent is required for message recipients.
Privacy Policy
Applicable to DM Companions apps and services
DM Companions is a healthcare software developed by You Na Technology Ltd. under commission from DM Companion Solutions Inc.
DM Companions respects and protects the privacy rights of all users who use its services and will handle your personal
information with diligence and care under this Policy. Unless otherwise provided, we will not disclose your personal
information to third parties without your prior consent. By agreeing to the DM Companions Service Agreement, you
are deemed to have agreed to all terms of this Privacy Policy.
1. Scope of Application
This Privacy Policy applies to the collection and use of personal information in the following situations:
When you register a DM Companions account, you provide personal registration information as required (e.g., name, date of birth, gender, and profile).
Data collected from your device to measure metrics such as steps, distance, calories burned, weight, heart rate, sleep stages, active minutes, and location (types vary by device).
Information automatically received and recorded when you use web services or visit our platform, including IP address, browser type, preferred language, access time, software and hardware information, and requested page records.
Personal information lawfully obtained by DM Companions from business partners.
Note: To improve your experience or enable certain features, you may choose to provide additional information such as food intake, weight, sleep, water consumption, or female health tracking logs.
2. Information Not Covered by This Privacy Policy
Search keywords entered when using DM Companions’ search services.
Public information you post on the platform collected by DM Companions, including participation in events, transaction records, and review details.
Information about violations of laws, regulations, or platform rules, and any measures taken by DM Companions in response.
3. Use of Information
We will not provide, sell, rent, share, or trade your personal information to unrelated third parties without your prior consent, unless such third parties (including affiliates) jointly provide services to you and, after completion, are prohibited from accessing such information.
We do not permit any third party to collect, edit, sell, or distribute your personal information by any means. Users found engaging in such activities may have their service agreement terminated immediately.
We use collected information to provide services and fulfill contractual obligations (e.g., providing dashboards and tracking health, exercise, activity, and trends). For community features, we may use your information to help you discover and connect with other users, and allow others to find and connect with you.
We may use your information to make inferences and show more relevant content, such as:
Using height, weight, gender, and age to improve the accuracy of activity statistics (e.g., calories burned and distance).
Inferring sleep patterns from sleep data to help you rest better.
Personalizing activity goals based on your previous goals and historical exercise/activity data.
Accessing clipboard information to provide convenient paste functionality. We only read content you explicitly paste and do not upload clipboard contents.
4. Disclosure of Information
DM Companions may disclose your personal information, in whole or in part, in the following circumstances:
With your prior consent.
When necessary to provide the products or services you request.
As required by applicable laws, regulations, or at the request of governmental, administrative, or judicial authorities.
When you violate Canadian laws or the DM Companions Service Agreement or rules.
When you are a qualified intellectual property complainant and disclosure is required to resolve a dispute with the respondent.
In platform transactions where either party requests disclosure to complete the transaction or resolve a dispute.
Any other disclosure deemed appropriate according to laws, regulations, or platform policies.
5. Information Storage
Information and data collected about you will be stored on servers of DM Companions and/or its affiliates, which may be accessed and stored in Canada or within jurisdictions where DM Companions operates.
6. Information Security
Your account is protected by security measures, including password encryption. Keep your username and password secure. While we take protective measures, no security system is impenetrable.
When engaging in online transactions via DM Companions, you may inevitably disclose personal information to counterparties (e.g., contact information or mailing address). Safeguard your data and only provide it when necessary. If you suspect compromise—especially of your username or password—contact us immediately for assistance.
For SOS communications, messages and calls are processed directly through your device’s operating system (Apple iOS or Android). DM Companions does not intercept, store, or forward these communications.
7. Auto‑Start and Associated Startup
To ensure the application can receive push notifications even when closed or running in the background, the application may use auto‑start or associated startup capabilities, initiated by system broadcasts at certain intervals. This is necessary to deliver services and functionality.
8. Children’s Personal Information
Our products, websites, and services are primarily designed for adults. Children under 16 may not create an account without a parent or guardian’s consent. If a child’s personal information is collected with such consent, we will only use or disclose it as permitted by law, with explicit guardian consent, or when necessary to protect the child. If we become aware that we collected a child’s personal information without verifiable parental consent, we will take steps to delete it promptly.
9. Account Deletion
You may delete your account via: DM Companions → My Profile → Security Settings → Delete Account. Upon deletion, we will cease providing services and, in accordance with PIPEDA and applicable regulations, anonymize or delete your personal information unless retention is required by law or regulatory authority.
10. Changes to This Privacy Policy
If we decide to change this Policy, we will publish such changes within this document, on our website, or in other appropriate locations to inform you of how we collect and use personal information, who has access to it, and under what circumstances it may be disclosed.
We reserve the right to modify this Policy at any time; please review it frequently. If significant changes are made, we will notify you via website announcements.
Any future updates that expand the SOS or emergency-related functionality will be clearly reflected in this Privacy Policy, and users will be notified before any new data types are collected.
11. SOS and Emergency Features
DM Companions provides an optional SOS feature designed to help you alert trusted contacts during urgent situations.
The SOS feature does not directly contact local emergency services (e.g., 911) and is not a substitute for professional emergency assistance.
When you activate the SOS feature, the app will open your device’s native SMS or phone interface to send a predefined message or initiate a call to your chosen emergency contacts.
We do not automatically send messages or place calls without your explicit action.
We do not store or transmit the content of your SMS messages or call logs to our servers.
Location data may be included in the message only if you have granted location access.
You can modify or disable your SOS settings at any time within the app.

1. Account Creation
To use the software provided by DM Companion Solutions Inc., you must first register an account for the DM Companions App and comply with these DM Companions Account Rules. If your account remains inactive for an extended period, DM Companion Solutions Inc. reserves the right to reclaim the associated account number, after which you will no longer be able to use that account.
1.1 Personal Accounts
You may create a DM Companions account through online registration. By registering, you agree not to use any false, inaccurate, or misleading information.
1.2 Business/Organizational Accounts
If you are creating a DM Companions account on behalf of an entity (e.g., your business or employer), you represent that you have the legal authority to bind that entity to these terms. You must not transfer account credentials to any other user or entity. To protect your account, you must keep your account details and password confidential and are responsible for all activities conducted under your account.
2. Account Usage
You must sign in and actively use your DM Companions account to keep it active, unless otherwise specified. If we have reasonable grounds to believe your account is at risk of unauthorized or fraudulent use (e.g., due to hacking), DM Companion Solutions Inc. may suspend your account until ownership can be verified.
3. Children’s Accounts
By creating a DM Companions account or using the services, you confirm that you have reached the age of majority or legal responsibility in your place of residence, or that your parent/legal guardian has consented to these terms on your behalf. If you are a parent or legal guardian, you agree to these terms both for yourself and for any minor using the account or services, and you accept responsibility for all activities conducted under that account (including purchases).
4. Closing Your Account
4.1 Voluntary Closure
You may cancel specific services or close your DM Companions account at any time for any reason.
4.2 Effects of Closure
Once your account is closed (by you or by us):
Your right to access DM Companions services ends immediately.
We will delete or anonymize data associated with your account unless we are legally required to retain it, or unless it is returned/transferred to you or a designated third party.
You will no longer have access to purchased products linked to your account.
You should maintain regular backups of your data, as DM Companions cannot retrieve content from closed accounts.
5. Family Interaction
Some services allow you to interact, create, generate, and share content with family members. These services use security measures to protect users and maintain service integrity.
6. Organizational Accounts
If you log into DM Companions business services using a corporate email address, you agree that the domain owner may:
Receive notifications related to your account.
Control and manage your account.
Access and process your data.
DM Companions may also notify the domain owner in case of account or data compromise. Your use of the services may be subject to additional agreements between DM Companion Solutions Inc. and your organization, which may override certain terms in this agreement.
7. Devices and Data Plans
Some services require an internet connection and/or a mobile data plan. You are responsible for providing the required connectivity, devices, and associated fees. These costs are not covered by DM Companion Solutions Inc. Please check with your service provider for applicable charges.
8. Service Notifications
We may send important service-related notifications to the email address, phone number, or in-app messaging system associated with your DM Companions account. Notifications may include identity verification requests and purchase confirmations. SMS or data fees may apply, depending on your carrier.
9. Termination of Services
If your service is terminated (either by you or us):
Your right to access the service ends immediately, and related software licenses are terminated.
Associated data or content may be deleted or anonymized unless retention is legally required or returned/transferred to you or a designated third party.
You may lose access to any products linked to the service.
If you have closed your DM Companions account and no other account remains to access the service, your service may be terminated immediately.
DM Companion Solutions Inc. / DM Companions Solutions Inc. (“IBYC” or “DM Companions” or “we”) attaches great importance to the privacy and personal information security of our users (“you”). We will do our utmost to protect the security of your personal information in accordance with applicable Canadian information security and privacy protection laws and regulations.
When you use our products and services, we may collect and use certain relevant information about you. This Privacy Protection Policy (“Policy”) applies to your use of our products and services through the Health Mobile Application (“Health App”) (collectively referred to as the “Services”). This Policy explains how we collect, use, store, share, disclose, and transfer your information, as well as how we provide you with access to, update, and delete such information.
Please ensure that you carefully read and fully understand the content of this Policy before using our products and services, and that you can make appropriate choices according to this Policy. By using the Health App and its related products and services, or by continuing to use them after we update this Policy, you signify your agreement to all contents of this Policy (including any updated versions) and consent to our collection and processing of your personal information in the manner and for the purposes described herein. If you do not agree to any part of this Policy, you should immediately stop using our products and services.
1. What Information We Collect and How We Use It
Categories of Information Collected
In order to provide our Services to you, we require certain personal information necessary to deliver those Services. If you do not provide such personal information, we may be unable to offer you our products or services.
We may collect the following categories of information (whether or not it constitutes personal information):
Profile Information: Mobile phone number, social media account, profile photo, nickname, gender, time zone, language and region, and emergency contact details (name and phone number).
Personal Health Data: Date of birth, height, weight, gender.
Device Data Records: When you use devices to sync health-related data, we may record personal information including but not limited to activity data (steps, effective activity volume, sedentary time, standing time, activity duration), posture, sleep, heart rate, blood pressure, blood sugar, uric acid, blood lipids, blood oxygen, body temperature, body weight, body composition (body fat percentage, muscle mass, water content, basal metabolic rate, visceral fat level, bone mass), ECG data, etc.
Behavior Tagging Information: When you choose to tag certain behaviors, the Health App may collect activity data, heart rate data, etc., to provide corresponding tagging functions.
Call Information: When you use incoming call and SMS reminder functions, the Health App may access call, SMS, and contacts data. With your permission, such data is displayed on wearable devices (e.g., wristbands, watches) but is not stored by the Health App.
Installed Applications List: When enabling third-party app message notifications, the Health App may access the list of installed apps on your device (with your permission) to turn on relevant message notification settings and display them on wearable devices.
App Auto-Launch: When enabling third-party app message push notifications, and with your permission, the App may auto-launch in the background to ensure continuous message delivery to your device.
Mobile Device Information: Operating system version, brand, and model.
Network Usage Data: Network type, network signal, and other relevant data.
Location Data: Collected when you use location-based services or features.
Feedback Information: When submitting feedback, we may collect feedback logs and your contact details (if provided).
Hardware Device Information: When connecting the Health App to hardware devices, we may collect device identifiers, firmware versions, approximate geolocation data (non-personal data), and feature usage statistics.
2. How We Use Personal Information
The primary purpose of collecting personal information is to provide you with products and/or services and ensure compliance with applicable laws. You hereby consent to our processing of your personal information for the purposes described in this Policy and to our disclosure of such information to our affiliated companies (involved in communications, social media, technology, and cloud services) and third-party service providers (as defined below).
3. Sharing Your Information
We do not sell personal information to third parties. We may disclose your personal information to third parties in order to provide the products or services you have requested.
Information Sharing Without Consent
We may share aggregated, anonymized information with third parties (e.g., retirement homes, insurance companies, healthcare providers) for health maintenance, wellness, or business purposes, such as general usage trends.
We may also disclose personal information without further consent when permitted or required by applicable data protection laws (e.g., to comply with a subpoena), or when we believe in good faith it is necessary to protect our rights, your safety, the safety of others, to investigate fraud, or to respond to government requests.
4. Security Measures
We are committed to safeguarding your personal information. We implement reasonable physical, electronic, and administrative measures to prevent unauthorized access, disclosure, or similar risks.
For example:
Two-step verification for enhanced account security.
SSL and encryption algorithms for secure data transmission.
Data stored on secure servers in controlled facilities.
Strict contractual confidentiality obligations for staff and third-party providers with access to personal information.
While we take all reasonable measures to protect your personal information, please note that internet transmissions are not always completely secure. We cannot guarantee the security or integrity of information during internet transmission.
5. Your Responsibilities
You are responsible for safeguarding your account credentials and not disclosing them to unauthorized individuals. You should log out after each session, especially on public or shared devices.
IBYC and DM Companions are not liable for any security breaches caused by your failure to maintain the confidentiality of your personal information. If you suspect unauthorized account use, notify us immediately.
6. Data Retention Policy
We retain personal information only as long as necessary to fulfill the purposes for which it was collected, or as required by applicable law. Once personal information is no longer needed, we will delete it or anonymize it, unless retention is necessary for legal, dispute resolution, or enforcement purposes.
7. Privacy Controls
We provide users with options to control the collection, use, and disclosure of personal information, including:
Logging in or out of your Health App account.
Enabling or disabling specific services or features that process personal or sensitive information.
You may request access to or correction of your personal information. Upon verifying your identity, we will respond within the time frame required by applicable data protection laws.
Data Storage Locations:
Users registered in Canada: data stored in Canada.
Users registered in the USA: data stored in the USA.
Users registered in Mainland China: data stored in Mainland China.
Users registered elsewhere: data stored in the country of registration.
If personal information must be transferred across jurisdictions, we will implement appropriate safeguards to comply with applicable laws.
8. Governing Law
This Policy is governed by Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).
9. Policy Updates
We may periodically review and update this Policy. Significant changes will be communicated via our website, Health App, or connected devices. Updates take effect from the date of notice. Continued use of our products or services constitutes acceptance of the updated Policy.
10. Third-Party Terms and Conditions
Our Privacy Policy does not apply to third-party products or services. We strongly recommend reviewing the privacy policies of any third-party services you use in connection with our products.
Our App uses third-party SDKs to enable SMS verification, device connectivity, health data synchronization, location services, and app stability optimization.
Examples include:
Twilio SDK (SMS Verification Service): May collect phone number, device info, IP address, and verification time for authentication and anti-fraud purposes. Twilio Privacy Policy
Bluetooth SDK (Bluetooth Communication Service): May access Bluetooth permissions, device name, identifiers, and connection status for pairing and data sync. Data is not uploaded to remote servers.
All SDKs operate only with your consent, and all data is collected solely for functional purposes with encryption and local storage safeguards.
12. Account Deletion
You may delete your account via Profile → Settings → Delete Account in the Health App. Account deletion is irreversible and results in the loss of all assets, subscriptions, and rights associated with the account, unless retention is required by law or regulatory authorities.
